The protection of your personal data is important to us. By using this website, you consent to the recording, use and transfer of your data in accordance with this Data Protection & Privacy Statement (“Statement”). Personal data are all information relating to an identified or identifiable person Person.

2 General use of the website

 

2.1 Access data

We collect information about you when you use this website. We automatically collect information about your usage patterns and your interaction with us and record data about your computer or mobile device. We collect, record and use data about each access to our online services (so-called server log files). The access data include the name and URL of the file accessed, date and time of access, amount of data transferred, notification of successful access (HTTP response code), browser type and version, operating system, referrer URL (i.e., the previously visited site), IP address, and the requesting provider. We use this log data – without allocation to your person or other profiling purposes – for statistical evaluations to support the operation, secure provision and optimisation of our online services, but also for anonymous recording of the number of visitors to our website (traffic) and the scope and type of use of our website and services, as well as for recording the number of clicks received from cooperation partners for billing purposes. This information enables us to provide personalised and location-based content and to analyse data traffic, identify and correct errors, and improve our services. We reserve the right to subsequently check log data if there is a justified suspicion of illegal use based on concrete indications. We store IP addresses in the log files for a limited period of time if this is necessary for security purposes or for the provision or billing of a service, e.g. if you use one of our services. After aborting the order process or after receipt of payment, we will delete the IP address if it is no longer required for security purposes. We also retain IP addresses if we have a concrete suspicion of a criminal offence in connection with the use of our website. In addition, we store the date of your last visit as part of your account (e.g. during registration, login, clicking links, etc.). 
The provision of such technical data is, in principle, neither required by law not by contract or necessary for the conclusion of a contract. You are not obliged to provide personal data. However, if your system does not or not fully provide the required information, this may result in our website not being able to be accessed at all or in full.

 

2.2 e-mail / contact

When you contact us (e.g. via contact form or e-mail), we store your details for processing your enquiry and for responding to any subsequent questions that may arise. We only retain and use further personal data if you consent to it or if this is legally permissible without special consent.

 

2.3 Newsletter

If you have subscribed to our newsletter, we will – subject to your consent – use your personal data, in particular your e-mail address and name, to transmit the newsletter. You can withdraw your consent at any time without giving reasons with effect for the future. Data processing is carried out on the basis of point (a) of Article 6(1) of the GDPR. We will store your data until you unsubscribe from the newsletter or withdraw your consent.

 

2.4 Cookies

We use session cookies for our online presence. Cookies are text files that are sent from our web server to your browser in connection with your visit to our website and are stored on your computer for later retrieval. Your name will not be transmitted. You can determine whether we are allowed to use cookies or not by selecting the appropriate settings on your browser. You can completely deactivate the storage of cookies in your browser, restrict it to certain websites or configure your browser to automatically notify you when a cookie is to be set. We do not collect or record personal data in cookies in this context. We exclusively use so-called session cookies, which do not allow tracking of user behaviour. We also do not use any technology that associates information generated by cookies – such as the IP address – with user data. Processing is carried out on the basis of point (b) of Article 6(1) of the GDPR. If we use cookies, they are automatically deleted at the end of the browser session. Detailed information on the cookies we use can be found in your browser. Cookies can also be manually removed from your system using a deletion function provided in your browser. The use of cookies is neither required by law nor by contract and is also not necessary for the conclusion of a contract. You are not obliged to provide personal data. If, however, you do not allow the use of cookies, this may result in some functions of the website not working or not working properly and/or certain content not being displayed or not being displayed properly.

 

2.5 Google Analytics

We use the "Google Analytics" service offered by Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA) to analyse website usage. Google Analytics uses so-called "cookies", text files placed on your computer to help analyse how you are using the website. The information generated by the cookie about the use of this website by its visitors is usually transferred to a Google server located in the USA and stored there. If IP anonymisation is enabled for this website, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. IP anonymisation is enabled on this website. Google will use this information on our behalf to evaluate the use of the website by you, to compile reports on the website activities, and to provide us with other services associated with the use of the website and the Internet. The IP address transmitted by your browser in connection with the Google Analytics service will not be merged with other data kept by Google. You can prevent the use of cookies by selecting the appropriate settings on your browser; however, please note that if you do, you may not be able to use the full functionality of this website. The legal basis for data processing as described above is point (f) of Article 6(1) of the GDPR. Our interests in data processing include, in particular, ensuring the operation and security of the website, investigating the manner in which visitors use the website, and making the use of the website as convenient as possible. Unless specifically stated, we will only store personal data for as long as is necessary to fulfill the purposes for which it was collected.

 

3 Your rights as data subject

Under the applicable laws, you have various rights with respect to your personal data. If you wish to exercise these rights, please send your enquiry by e-mail or postal service to the address stated in paragraph 1, clearly identifying yourself. In the following, you will find an overview of your rights.

 

3.1 Right to confirmation and information

You have the right at any time to request from us confirmation as to whether personal data concerning you are being processed. If this is the case, you have the right to obtain information about the personal data stored about you including a copy of these data free of charge. Furthermore, you have a right to the following information:

  1. the processing purposes;
  2. the categories of personal data processed;
  3. the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular if recipients in third countries or international organisations are involved;
  4. the planned duration, if possible, for which the personal data will be stored or, if that is not possible, the criteria for determining that duration;
  5. the existence of a right to rectification or erasure of personal data concerning you or to restrict the processing by the Controller or to object to such processing;
  6. the existence of a right to lodge a complaint with a supervisory authority;
  7. in the case of personal data that are not collected from you, all available information about the origin of the data.

 

3.2 Right to rectification

You have the right to demand from us the immediate rectification of inaccurate personal data concerning you. Taking into account the purposes of the processing, you have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

 

3.3 Right to erasure

You have the right to obtain from us the erasure of personal data concerning you without undue delay and we have the obligation to erase personal data without undue delay where one of the following grounds applies:

  1. The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
  2. You withdraw consent on which the processing is based according to point (a) of Article 6(1) or point (a) of Article 9(2) of the GDPR and where there is no other legal ground for the processing.
  3. You object to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Article 21(2) of the GDPR.
  4. The personal data have been unlawfully processed.
  5. The personal data have to be erased for compliance with a legal obligation under Union or Member State law to which we (as the Controller) are subject.
  6. The personal data have been collected in relation to the offer of information society services referred to in Article 8(1) of the GDPR. Where we have made the personal data public and are obliged to erase the personal data, we, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform controllers which are processing the personal data that the you have requested the erasure by such controllers of any links to, or copy or replication of, those personal data.

 

3.4 Right to restriction of processing

You have the right to obtain from us restriction of processing where one of the following applies:

  1. the accuracy of the personal data is contested by you, for a period enabling us to verify the accuracy of the personal data;
  2. the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead;
  3. we no longer need the personal data for the purposes of processing, but they are required by you to establish, exercise or defend legal claims; or
  4. you have objected to processing pursuant to Article 21(1) of the GDPR pending the verification whether the legitimate grounds of our company override yours.

 

3.5 Right to data portability

You have the right to receive the personal data concerning you, which you have provided to a us, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from us, where:

  1. the processing is based on consent pursuant to point (a) of Article 6(1) or point (a) of Article 9(2) of the GDPR or on a contract pursuant to point (b) of Article 6(1) of the GDPR; and
  2. the processing is carried out by automated means. In exercising your right to data portability pursuant to paragraph 1, you have the right to have the personal data transmitted directly from us to another controller, where technically feasible.

 

3.6 Right to object

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) or (f) of Article 6(1) of the GDPR, including profiling based on those provisions. We no longer process the personal data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims. Where personal data are processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing. Where personal data are processed for scientific or historical research purposes or statistical purposes pursuant to Article 89(1) of the GDPR, you, on grounds relating to your particular situation, have the right to object to processing of personal data concerning you, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

 

3.7 Automated individual decision-making, including profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

 

3.8 Right to withdraw consent under data protection law

You have the right to withdraw a consent to the processing of personal data at any time.

 

3.9 Right to lodge a complaint with a supervisory authority

You have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you is unlawful.

 

4 Data security

We make every effort to ensure the security of your data under consideration of the applicable data protection laws and technical possibilities. We will transmit your personal data encrypted. This applies to your orders and also to the customer login. We use SSL (Secure Socket Layer) coding, but would like to point out that data transmission over the Internet (e.g. communication by e-mail) can be subject to security gaps. Complete protection of the data against access by third parties is not possible. To secure your data, we maintain technical and organisational security measures, which we constantly adapt to the state of the art. Furthermore, we do not guarantee that our services will be available at specific times; disruptions, interruptions or failures cannot be ruled out. We use servers that are regularly and carefully backed up.

 

5 Automated decision-making

There is no automated decision-making on the basis of the personal data collected.

 

6 Transfer of data to third parties, no data transfer to non-EU countries

We generally use your personal data only within our company. If and to the extent that we involve third parties in the performance of contracts (such as logistics service providers), these parties will only receive personal data to the extent necessary for the provision of the corresponding service. In the event that we outsource certain parts of our data processing (contract processing by “Processors"), we contractually require Processors to use personal data only in accordance with the requirements of the applicable data protection laws and to protect the rights of the Data Subject. Except for the cases referred to in this Statement in point 2.5, no data will be transferred to entities or persons outside the EU and there are no plans to do so.
